Salty Snapshots Photobooth Rental Agreement
The following contract and its terms will set forth an agreement between Salty Snapshots Photobooth Rentals (Provider) and ________________________(Client) for photobooth services for an event taking place at _______________________. This written contract sets forth the full, written intention of both parties and supercedes all other written and/or verbal agreements between the parties.
The service period will begin at ___________ on (DATE) ________________ and will terminate at ___________ on (DATE) _________________. Provider agrees to have a photobooth operational for a minimum of 80% during this period; occasionally, operations may need to be interrupted for maintenance of the the photobooth.
A non-refundable deposit in the amount of $200 is due upon the signing of this contract. The remaining balance is due 10 days prior to the clients event. If the provider uses the equipment for a time period in excess of service period agreed to in the invoice below, the overage of rental time will be billed to the client at the rate of $200 an hour. Payment for any overage is due within 14 days after the clients event.
ACCESS, SPACE AND POWER FOR PHOTOBOOTH
Client will arrange for an appropriate space for the Photobooth at the event's venue. (10' deep x 10' wide x 8' high) Client is responsible for providing power for the Photobooth. The Photobooth requires a 110V, 10 amps, 3 prong outlet from a reliable power source within 50 feet (along a wall) of the setup area. The circuit must be free of all other connected loads. Any delay in the performance or damage to the Photobooth equipment due to improper power is the responsibility of the client. The client shall provide crowd control if warranted and furnish Salty Snapshots with directions to the event. Client shall provide Salty Snapshots with safe and appropriate working conditions and a solid and level floor. Client agrees Salty Snapshots will not be held liable for any lack of service due to Client's failure to provide these requirements.
DATE CHANGES AND CANCELLATIONS
We require a $200 deposit upon booking the event. This reserves your date. The remainder of the payment is due no later than 10 days prior to the event. If the full balance is not paid 10 days prior to the event your reservation is no longer valid and you forfeit the deposit. All payment, including deposits and full balances, are non-refundable and non-transferable on cancellations made 30 days or less prior to the event. Cancellations made 30 days or more in advance to the event will receive a 50% refund on all payments, not including the $200 retainer deposit. Any request for a date change must be made in writting at least 30 days in advance of the original event date. Date change is subject to Photobooth availibility and recipt of a new Service Contract. If there is no availibility for the alternate date, time or location, the non-refundable deposit shall be forfeited and event cancelled. If event is cancelled for any reason, the non-refundable reservation fee is forfeited.
Client will not be reimbursed for time lost due to willful or accidental damages to equipment inflicted by client or guests. Should client or any guest be physically or verbally violent towards Salty Snapshots staff or eqiupment, Salty Snapshots hold the right to end the rental service early with no compensation for lost rental time to client. Client acknowledges that it shall be responsible for any damage(s) or loss to the Providers equipment caused by any misuse by Client or Client's guests.
LIMITATION OF LIABILITY
While every reasonable effort will be made to produce and deliver an outstanding service, Salty Snapshots entire liability to Client for any breach of this agreement, claim, loss or injury arising from Salty Snapshots performance is limited to a refund to Client of amount paid for its services less the value of the services provided. No refund will be given if the Client elects to not use all of the time rented from Salty Snapshots. For example, if your rental is from 4pm-10pm yet the party ends early at 9pm and you instruct our attendant to break down and leave early, you will not be eligable for a refund of the 1 hour that did not get used.
Client agrees to and understands the following:
a.) Client will indemnify Provider against any and all liability related to Client's event during or after Client's event. Client will indemnify Provider from the time of service and on into the future, against any liability associated with Client.
b.) Client will indemnify provider against any and all liability associated with the use of pictures taken within the Photobooth, it's representitives, employees or affiliates at Client's event.
c.) Client will indemnify Provider against any and all liability related to injury from misuse of the photobooth, props, or any other property of provider.
MODEL RELEASE OPTION
Provider is not responsible for obtaining model, property or other releases in connection with any of the photographs taken within the Photobooth at Client's event. Client claims all responsibility to obtaining such releases prior to publication of photographs taken at Client's event. All guests using the Photobooth hereby give to Salty Snapshots the right and permission to copyright and use photographic portraits or pictures of any Photobooth user who may be included intact or in part, made through any and all media now or hereafter, known for illustration, art, promotion, advertising, trade or any other purpose. In addition, Client hereby gives release, discharge and agree to Salty Snapshots from any liability, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
If any provision of these terms shall be unlawful, void or for any reason unenforceable under Massachusetts Contract Law, than that provision, or portion thereof, shall be deemed seperate from the rest of this contract and shall not affect the validity and enforeability of any remaining provisions, and portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to have any and all matters heard before a court of law in Dukes County, Massachusetts unless the Provider agrees to the contrary in writing , signed by both parties. In the event the Provider is unable to supply a working Photobooth for at least 80% of the service period, Client shall be refunded a prorated amount based on the amount of service received. If no service is received, Providers maximum liability will be the return of all payments received from Client. Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
ALL SALES ARE FINAL
Client understands and agrees that all sales and service fees are final.
